2 Kenyan ‘Boda Boda’ Riders Sentenced to Death for Stealing Laptop

Man behind bars DAILY NATION

Two boda boda riders from Nyeri,Kenya were sentenced to death for stealing a laptop after losing an appeal in a high court.

The two, Simon Kamau and Daniel Mwatha, were handed the sentence by a Nyeri High Court after conviction.

Handing them over to the hangman, Justice Abigail Mshila dismissed the duo’s appeal upholding an earlier ruling by a lower court.

According to court records, the riders robbed their victim, Maurine Mumbi of her laptop and personal items valued at Ksh73,000.

A court room

They were armed with a knife as they accosted her at Dedan Kimathi University back in February 2014.

The two reportedly left the motorbike at the scene of the crime as they fled.

The penal code prescribes that if the offender is armed with any dangerous or offensive weapon or instrument, or is in company with one or more other person or persons, or if, at or immediately before or immediately after the time of the robbery, he wounds, beats, strikes or uses any other personal violence to any person, he shall be sentenced to death.

In the case of attempted robbery, any person who assaults any person with intent to steal anything, and, at or immediately before or immediately after the time of the assault, uses or threatens to use actual violence to any person or property in order to obtain the thing intended to be stolen, or to prevent or overcome resistance to its being stolen, is guilty of a felony and is liable to imprisonment for seven years.

Earlier on, the Supreme Court ruled that the mandatory death sentence was unconstitutional as it violates dignity, access to justice and the right to fair trial by taking away the judges’ discretion in considering mitigating factors.

The court, however, made it clear that the death sentence had not been outlawed but rather, should be a discretionary sentence, and proceeded to give guidelines to be used in assessing mitigating circumstances.

President Rodrigo Duterte Vows To Resign if someone proves God Exists

Filipino President Rodrigo Duterte questioned some of the basic elements of Catholicism in a speech on Frida on 7 July.

  • The Filipino President recently called God a ‘stupid son of a b****’ in a speech
  • He challenged people to ‘take a selfie with God’ to prove his existence Sunday
  • Duterte angered Catholic figures throughout the Philippines with his comments
  • The Philippines is a predominantly Catholic country with 76 million believers

The Philippine president, who recently sparked outrage for calling God stupid, has courted new controversy in his largely Roman Catholic country by saying he will resign if anybody can prove that God exists.

President Rodrigo Duterte, who has had a thorny relationship with the church, questioned anew in a speech late Friday some of the basic tenets of the Catholic faith, including the concept of original sin, which he said taints even innocent infants and can only be removed through baptism in a church for a fee.

‘Where is the logic of God there?’ Duterte asked in a speech at the opening of a science and technology event in southern Davao city.

Filipino President Rodrigo Duterte questioned some of the basic elements of Catholicism in a speech on Friday

The 73-year-old leader said that if there’s ‘one single witness’ who can prove, perhaps with a picture or a selfie that a human was ‘able to talk and to see God,’ he will immediately resign.

Duterte, however, suggested that there must be a God or a supreme being that prevents billions of stars and celestial bodies from colliding in a frequency that could have long threatened the human race.

Last week, he was slammed, including by some of his political allies, for calling God ‘stupid’ in another speech, with one Catholic bishop calling him a ‘psychopath.’

Duterte lamented in that speech that Adam and Eve’s sin in Christian theology resulted in all the faithful falling from divine grace.

‘Who is this stupid God? This son of a bitch is then really stupid,’ he said last week. ‘You were not involved but now you’re stained with an original sin … What kind of a religion is that? That’s what I can’t accept, very stupid proposition.’

Opposition Sen. Antonio Trillanes IV shot back at Duterte by describing him as ‘one evil man’ and his remarks as ‘very much consistent with the deceitfulness, heartlessness and ruthlessness of his policies.’

Presidential spokesman Harry Roque has defended his remarks, saying Duterte has the right to express his opinion on religion and cited the president’s previous disclosure that he was once sexually abused by a priest.

Duterte on Friday recalled that experience, when he said he and other students were fondled by a foreign Jesuit priest, who has since died.

Amid the criticisms, officials have arranged a meeting between Duterte and the head of the largest association of Catholic bishops on Monday.

Filipino bishops opened an annual conference in Manila Saturday and were expected to address Duterte’s tirades when they conclude their meeting on Monday.

Some Catholic bishops have been critical of Duterte’s brutal crackdown against illegal drugs, which have left thousands of suspects dead in reported clashes with the police, along with his vulgar and expletives-laden speeches.

He once called Pope Francis a ‘son of a bitch’ for sparking a monstrous traffic during a 2015 visit in Manila that trapped Duterte for hours.

The first-time politician is alleged to have engaged in activities to undermine the government of Uganda and its President Yoweri Kaguta Museveni.

In the letter, the Minister stated that Babu was compliant in the subversive activities of Kyaddondo East MP Robert Kyagulanyi popularly known as Bobi Wine.

“During Bobi Wine’s visit to Kenya last month, Babu hosted Wine in a number of functions and events. The duo uttered inflammatory and seditious words against the democratic and legitimate rule of President Yoweri Museveni,” General Odongo conveyed.

He went further to warn any person found aiding or abetting the violation of the directive would be in contravention of a legal order and would face prosecution.

In diplomacy, a persona non grata is a foreign person whose entering or remaining in a particular country is prohibited by that country’s government.

Being so named is the most serious form of censure which a country can apply to foreign diplomats, who are otherwise protected by diplomatic immunity from arrest and other normal kinds of prosecution.

-She will appear in court on November 9

A prominent Ugandan activist is back in jail, accused of making “obscene comments” on her Facebook page about President Yoweri Museveni and his late mother.

Dr Stella Nyanzi, a Makerere University researcher and an activist, appeared in court in Kampala on Wednesday on charges of cyber harassment and offensive communication.

She is accused of insulting President Yoweri Museveni and his deceased mother, Ms Esteri Kokundeka, in a Facebook post on September 16.

In the post, Dr Nyanzi argued that she could not let Ms Kokundeka rest in peace while her son continued to suffocate Uganda with corruption, lawlessness and dictatorship.

“Dr (Stella) Nyanzi appeared in court today after five days in police cells and she was charged for allegedly disturbing the peace, quiet, or right to privacy of President Museveni and his late mother,” the academic’s lawyer Isaac Semakadde told AFP.

She was then sent back to prison as the presiding magistrate had no jurisdiction to hear the case, Semakadde said, adding: “We are working to secure her release.”

Good people

Ms Kokundeka died in November 2001.

In a hand written letter to a friend, widely shared on social media, the controversial don vowed to continue fighting for her freedom.

“This is the fourth day I am sleeping in a detention at Kira Division Police Station. The police officers are good people. They are not only protecting me, but they also taking care of my needs. Thank you for bringing me breakfast every morning, I share it with the other female cell mates locked up with me,” the letter reads.

Her indictment follows the detention of another woman, Ms Susan Namata, who is also accused of abusing President Museveni.

Another charge

In September, Ms Namata had in a video threatened to hit President Museveni’s teeth with her genitals over the arrest of Kyadondo East Member of Parliament Robert Kyagulanyi, popularly known as Bobi Wine.

This is not Dr Nyanzi’s first attack on the president as she is facing another charge for allegedly describing President Museveni as “a pair of buttocks” and his wife, Janet, “empty-brained” in posts on her Facebook page in April last year.

The case is still ongoing.

Dr Nyanzi was arrested on November 2 and remanded. She will appear in court Friday.

Nyanzi, an academic, made a name for herself with her offensive comments about the man who has ruled the East African nation for 31 years, last year.

Her colourful posts have attracted both scorn and applause in Uganda, a traditionally conservative country, but one where many are fed up with Museveni’s long rule.

South Africa is on the path to becoming another Zimbabwe – and may require US intervention: analyst

By Staff Writer
American think-tank, the Cato Institute, has published a warning of the possible effects that expropriating privately-owned farmland may have on South Africa.

In the post published on Monday (20 August), the institute’s Marian L. Tupy said that eighteen years ago Zimbabwe embraced a similar policy.

“As a consequence, South Africa’s northern neighbor’s economy collapsed and the country descended into penury and political violence,” he said.

“This scenario is likely to repeat itself in South Africa. An attack on property rights will result in the destruction of South Africa’s farming community, dramatic reduction in agricultural productivity, and mass unemployment.

“It could also lead to a collapse of the banking sector (which depends on land as collateral for loan-making) and the local currency, hyperinflation, and even bloodshed.”

Tupy added that in the early 1990s, the United States was heavily involved in negotiating the transfer of power from the ruling National Party to the current government, and as such bears some responsibility for ensuring that South Africa’s post-apartheid political settlement, including protection of minorities and private property, endures.

“President Trump should warn the South African government that if South Africa’s Constitution is amended to allow for expropriation without compensation, South Africa will be suspended from the African Growth and Opportunity Act (AGOA), as Zimbabwe had been,” he said.

“Moreover, the US Congress should hold hearings on the situation in South Africa, if the government of South Africa continues its destructive economic policies.”

The African Growth and Opportunity Act

Section 104 of AGOA states that a sub-Saharan African country is eligible for membership of AGOA if it:

Protects private property rights, incorporates an open rules-based trading system, and minimizes government interference in the economy through measures such as price controls, subsidies, and government ownership of economic assets;
Respects the rule of law, political pluralism, and the right to due process, a fair trial, and equal protection under the law.
“Furthermore, the text of AGOA states that if the President determines that an eligible Sub-Saharan African country is not making continual progress in meeting the requirements described in … Section 104 the President shall terminate the designation of the country as being eligible for membership of AGOA,” said Tupy.

“Considering that South Africa is in breach or is about to breach a number of requirements for membership of AGOA, the president should act by issuing a preemptive warning to the South African government.”

-The National Assembly want catering services outsourced to have the MPs enjoy Five-Star Hotel services

Kenyan Members of Parliament have protested ‘poorly’ prepared food served in Parliament’s cafeteria.

The National Assembly want catering services outsourced to have the MPs enjoy Five-Star Hotel services.

Consequently, the MPs on Wednesday demanded implementation of the House report that recommended radical changes in catering services.

Majority Leader Aden Duale led the House in demanding implementation of the changes, protesting the quality of food served to MPs had gone down.

“We must outsource this service. The legislature cannot do business of cooking food. This should be given to the right people,” said Mr Duale.

According to the Standard, they want Parliamentary Service Commission to hire professional chefs comparable to those hired by Five Star Hotel in the city.

The report authored by Committee on Members’ Services and Facilities after bench-marking in the United Kingdom and the Northern Ireland assembly further recommended construction of two more cafeterias on the ground floor of the Red Cross building.

The lawmakers have further recommended overhaul renovation of the current Kitchen, restaurant, bar, still room and members’ lounge.

The MPs also want the commission to consider developing a training plan for catering staff based on the proposed skills audit, and attachment for catering staff in five-star hotels.

They also want toilets adjacent to the main reception in the main building be cleaned frequently to address the bad smell emanating from there.

The committee chairman Ezekiel Machogu said his committee has been talking to Speaker Justin Muturi to ensure the report is implemented.

“I tabled a report containing 50 recommendations to the PSC. We have been following this and have made a call to the chairman of the PSC over this because only 20 per cent of the recommendations have been adopted,” he said.

Breaking News:Gabon outsted President Ali Bongo dies

IBREVILLE -Gabon President Ali Bongo has died after getting a stroke last month.

Gabon’s top court had ruled that the vice president will chair the cabinet in the absence of President Ali Bongo, who had remained in hospital in Saudi Arabia.

The decision, announced by the constitutional court on Wednesday, is the first move to fill the vacuum left after Bongo was admitted to hospital during a conference on Oct. 24.

Bongo had not been seen in public since  his state of health. The government had said he suffered a bout of fatigue and is recovering, but sources told Reuters that he had a stroke.

“Only the president has the power to chair the Council of Ministers. Unfortunately, he is temporarily unavailable for health reasons, and temporary unavailability is not addressed by the constitution,” said Gabon’s Prime Minister Emmanuel Issoze Ngondet, who leads the cabinet.

The Bongo family has confirmed his death but says more will be unveiled to media in due course.

Egyptian king or dwarf? Mohamed Salah statue mocked online

This picture shows a statue of Liverpool's Egyptian forward Mohamed Salah displayed at the World Youth Forum in Sharm el-Sheikh, on November 5, 2018|AFP

Cairo,Egypt – A statue of Liverpool footballer Mohamed Salah has been met with derision online since going on display in his native Egypt, with many comparing it to an infamous bronze bust of Cristiano Ronaldo.

The statue was unveiled with pomp and ceremony at the World Youth Forum in the Egyptian resort of Sharm el-Sheikh in the presence of President Abdel Fattah al-Sisi.

With large ears poking out from under a huge Afro hairstyle, Salah is captured in the pose of his now iconic goal celebration.

A broad smile is etched across his face and his oversized head is tilted backwards as the arms on his pint-sized body are stretched out wide.

Salah is idolised in Egypt and Liverpool, after his goal-scoring exploits last season took his country to the World Cup finals and his English club to the final of the Champions League.

The statue of him been mocked widely on social media, with many likening its appearance to that of 1970s British singer Leo Sayer or his American counterpart Art Garfunkel.

“People thought Cristiano Ronaldo’s statue was bad. Wait till you see Mo Salah’s,” one Twitter user wrote, referring to the bronze bust ridiculed for looking nothing like the Portuguese football superstar.

A woman takes a selfie by a statue of Liverpool’s Egyptian forward Mohamed Salah displayed at the World Youth Forum in Sharm el-Sheikh, on November 5, 2018

“Statue carved by Stevie Wonder by the looks of it!” tweeted another, in reference to the blind US musician.

One social media user said Salah’s statue looked like a “bobble head” — the dolls placed on the dashboards of cars with oversized heads that nod incessantly.

“Oh god!!!!!! They made statute of dwarf Salah,” tweeted another.

“Yes, it’s a statue, but where is Mohamed Salah?” said a post on Facebook.

The Egyptian artist who sculpted the statue, Mai Abdallah, has defended her work.

Abdallah said the statue had been made of plaster but became disfigured when the forum’s organisers poured bronze over it, much to her surprise.

She said the statue was originally only meant to be used teach sculpture to students, in a post on Facebook where she also shared her other statues of Egyptian celebrities.

Africa’s ‘Mona Lisa’ returns home after 40 years

It went missing for 40 years, but now “Tutu” by the late Nigerian artist Ben Enwonwu has gone on show again in its home country, at the Art X event in Lagos. Rosanna Philpott reports.

By CGTN Africa
Nigeria’s most expensive painting, Tutu, also known’s Africa’s Mona Lisa, was exhibited in the country’s commercial capital, Lagos, for the first time since its disappearance over 40 years ago.

It went missing for 40 years, but now “Tutu” by the late Nigerian artist Ben Enwonwu has gone on show again in its home country, at the Art X event in Lagos. Rosanna Philpott reports.

The painting which was found in a London flat in February, and auctioned for $1.5m (£1.2m) to an anonymous buyer, was the highest-valued work at the three-day ArtX Lagos fair, which ended on Sunday.

Tutu, by Nigeria’s best-known modern artist, Ben Enwonwu, was painted in 1974 and appeared at an art show in Lagos the following year. It then disappeared until it re-surfaced in north London.

The painting is a portrait of Adetutu Ademiluyi, a grand-daughter of a traditional ruler from the Yoruba ethnic group.

It holds special significance in Nigeria as a symbol of national reconciliation after the 1967-1970 Biafran War.

The owners – who wished to remain anonymous – had called in Giles Peppiatt, an expert in modern and contemporary African art at the London auction house Bonhams, to identify their painting. He recognised Enwonwu’s portrait.

“It was discovered by myself on a pretty routine valuation call to look at a work by Ben Enwonwu,” said Mr. Peppiatt.

“I didn’t know what I was going to see. I turned up, and it was this amazing painting. We’d had no inkling Tutu was there. How it got there remains a bit of a mystery,” Peppiatt said.

Kenya-Uhuru Kenyatta Rejects China 325Bn Loan

Kenyan President Uhuru Kenyatta has rejected China loan totalling to 325Bn Shillings. In his defense the Kenyan president said that it will be difficult to run the country with all the laons they have received from China.

Already Kenya is facing huge amount of Loans from Both World Bank and China.

Some of the collaterals of China loans include Mombasa port. Some countries like Zimbabwe have faced the wrath of not paying Chinese loans as their ports have been taken over by China.

The Kenyan president’s rejection of foreign media criticism regarding Nairobi’s debt burden confirms that countries receiving aid and other forms of support are in the best position to judge China’s cooperation with the African continent, an analyst said.

Asked in a CNN interview on Oct 26 whether he worries about rising loans from China, Kenyan President Uhuru Kenyatta questioned why the focus was on one particular lender while Kenya also receives funds from other states and organizations.

Kenya has a very healthy mix of debt from various lenders in addition to China, including the United States, Japan and France, as well as the World Bank and the African Development Bank, he said. Kenya has its own development agenda, he said, and is willing to partner with all countries that help it achieve its objectives.

“Such objective remarks affirm the cooperation between China and Kenya,” said Zhang Xiaomin, an associate professor of international relations at Beijing Foreign Studies University.

China’s foreign financing support is based on recipients’ needs and local conditions, and focuses on capacity building in those countries, Zhang said, adding that the efficiency and influence of the cooperation with China is obvious to all.

Foreign media’s dwelling on the “debt trap” is biased and demonstrates that they lack objective understanding of China’s cooperation with developing countries, he added .

State Councilor and Foreign Minister Wang Yi, visiting Papua New Guinea, rebutted on Wednesday claims that China’s aid for Pacific countries was a burden.

During the joint news conference with PNG Foreign Minister Rimbink Pato, Wang said that China’s foreign aid is carried out on the basis of equality, mutual benefit, openness and sustainability.

China’s aid for Pacific countries represents mutual support and assistance between developing countries, and is an important part of South-South cooperation, Wang said.

Beijing’s foreign aid is offered on an equal basis, with full respect for the will of the governments and people of the recipient countries. It comes without interfering in domestic affairs or any political strings attached, he said.

The country always ensures that foreign aid is mutually beneficial, taking into consideration the financial sustainability of the recipients when carrying out aid projects, he said.

China offers foreign aid in an open manner, he added, and is willing to carry out third party cooperation with other countries.

Moreover, China’s foreign aid is sustainable and is aimed at empowering recipients to overcome their development bottlenecks and achieve self-supported and sustainable development, he said.

China always places a priority on justice. This approach can stand the test of time and the judgment of the international community, Wang said.

Those who criticize China’s good deeds should instead do more themselves to help Pacific island countries, he added.
